I. Delivery

1.1a   Your credit card will only be charged once your goods are shipped. Celluloco.com does not guarantee color choices in any of the orders it processes. If color is a delicate issue for you, call us at (786)236.9999 to ensure that we have the color you ordered in stock on the very same day you place the order with us.

1.1b If you ordered an Apple Factory (never locked) iPhone product, your order may take up to 4 (four) working days to be shipped. On all Apple Direct product orders with Celluloco.com being paid with a foreign credit card and/or being shipped outside of the U.S., the customer agrees to an additional US$100.00 (one hundred dollars) charge that will serve to cover our costs of registry of ownership of your mobile's IMEI# (serial number) with Apple USA on your behalf to act as the American product warranty registrar for any and all warranty redemption procedures should these occur for the period of up to one year of your purchase.

1.2  Due to the large product inventory turn over, if the item you bought (SKU) is not physically available for immediate shipment at the time we capture your order, you agree to allow us to substitute the item you purchased (SKU) for a different version of the same product (SKU) family that may carry a different price as advertised on that product page's "ALSO AVAILABLE IN" tab.

(i.e. An example would be to buy a Blackberry 8900 Javelin (Base Pack) that may not be available at time of order placement to have it replaced by Celluloco.com with a Blackberry 8900 Javelin (Deluxe Pack 8GB). Celluloco.com will make the necessary adjustments on your order to reflect the product substitution viewable in your order history with us. Our assurance that you will always receive the same make and model of mobile that you ordered, regardless of version available, is a our commitment to guarantee order execution and timely delivery. As always, we invite you to contact us to prior to your placement of your order to get a live physical check of inventory on the day that you place your order.)

1.3   You agree to hold us harmless in case of any of any post delivery loss of your goods.  Example: front desk/concierge of your billing address signs for your package and it is lost after they have have taken legal, written possession of your goods. Example 2 : At your request, we may leave the package without a signature requirement in your front door and the package disappears before you, the buyer, can get to it.

1.4   Celluloco.com will charge your credit card for any charges we incur from re-routing your order to the correct address in case the one you provide us turn out to be incorrect. If your address is considered to be in a remote area as per United States Postal Service's official records, we will assess a US$30.00 fee to your credit card for an period of up to 30 days from the shipment of your order (this is the time frame it takes for UPS to inform us of such events through their billing services to you). In case of a refused shipment or unsuccessful delivery, we will charge your credit card double freight (from and back to our warehouse)and a 25% restocking fee over the full price of your purchase with us.

1.5 Celluloco.com will charge a flat US$45.00 fee for preparation of Customs compliance paperwork (i.e. SED and Commercial Invoice) for all international orders. All international orders will incur an additional US$35.00 fee for the processing of a foreign issued payment (i.e. payment through a non U.S. credit card or a non US initiated bank wire). Both of these fees (if and when applicable) will be added to you to your order placed online or by phone whose updated receipt will be emailed to you within 72 hours of the actual shipment of your order.

1.6   All orders must be signed for in person at the address of intended delivery.  NO EXCEPTIONS WILL BE MADE.  In case you cannot be physically available when the UPS driver will deliver your package or in the case where you have missed a delivery attempt, you may call 1-800-PICK-UPS, say the world "REP" to bypass their annoying automated menu and ask for the address of the UPS Hub near you where you package is being held so that you may pick it up at your convenience.  Most of these hubs do close at 8:30pm.  Don't forget to take a pictured I.D. with you as you be requested to identify yourself as the consignee prior to signing for your package.

1.7   Buyer must take delivery of any orders we mark as "SHIPPED" in our system since these describe orders that have already been handled, picked, packed and shipped.  Shipped orders can only be returned by following proper return guidelines set forth in our Return Policy.  Please be reminded that we send all tracking numbers out at the end of each business day, at 8PM EST, Monday through Friday and by 5PM EST on Saturdays.  As we understand that there could be errors in email delivery, we also post the tracking number in your account for your viewing. Please note that due to a recycling of tracking numbers done by carrier, your particular tracking information will only be accurate if you check it on the carrier's site after 8PM of the day you receive the tracking information from us. You may check the status of your order at any time by logging in to your account.  

II. Manufacturer Product Warranty 

ALERT: PLEASE UNDERSTAND THAT THE PRODUCT WARRANTY ON ALL ITEMS ON THIS SITE IS OFFERED BY THE MANUFACTURER AND NOT BY CELLULOCO.COM. FURTHERMORE, THE PRODUCT WARRANTY IS VALID OUTSIDE OF THE U.S. ONLY (ALL ITEMS ARE IMPORTS!) - and YES, IT IS LEGAL TO SELL PRODUCTS INSIDE THE U.S. WITHOUT A MANUFACTURER'S WARRANTY INSIDE THE U.S. SO AS LONG AS THE COMPANY DISCLOSES THIS CLEARLY, IN A NON-CONSPICUOUS MANNER PRIOR TO THE PURCHASE AND FOR AS LONG AS THERE IS A MANUFACTURER'S PRODUCT WARRANTY IN PLACE, REGARDLESS OF COUNTRY. Celluloco.com informs you about such lack of U.S. manufacturer warranty in both the "includes" tab of the product your bought and in your checkout process as well!

2.1 Celluloco.com offers both warranty of merchantability and of fitness of use on all of its products, both of which are guaranteed to you through our 10 Satisfaction Guarantee Policy.  Please bear in mind that data transfer compatibility issues of our media devices with your wireless service providers are not protected by these warranties.   All returned items under our 10 day guarantee must follow strict guidelines explained in our Return Policy.

2.2 Celluloco.com does not make any implied, written or verbal warranties with regards to the compatibility of the mobiles we trade on this site with any carriers in the world. Buyers should understand that the manufacturers of the imported mobiles we trade are the ones that make the claim of GSM frequency network support, not compatibility. The compatibility issue is one fully controlled the ever changing actions of the carriers themselves with respect to service deployment in the user's primary area of coverage. In plain words, if a mobiles says it supports 1900Mhz GSM frequency on our site and you are complaining about bad signal or lack data services support, it may be that your carrier decided to swap your frequency to 850Mhz and you do not even know about it. Celluloco.com nor the manufacturer can make any warranties regarding compatibility for the aforementioned reason as well as many others outside of our control.

2.3  Should you have a technical issue with your purchase after the 10 day period allowed to you, Celluloco.com does offer technical support online to assist you in resolving the issue on a basic level.  In case of full blow technical failures, we do recommend that you recourse your Manufacturer's Warranty which is in effect for a period of up to one (1) year from your purchase date.  Please be reminded that mobile batteries carry only a fifteen (15) day manufacturer's warranty and that some our mobiles do have foreign based warranties.  For information on manufacturer's warranty redemption, please click here.

2.4  Customers are reminded that most of our media devices are imports and might not come with an English manual since they were not meant to the American market at the time of their inception.  They all do, however, come with full English firmware loaded on them and if your mobile arrived in a foreign language, please click here to find out how to set it to English. Your English User's Guide to your media device may be available for immediate download on that product's page in our site in the form of a .pdf Acrobat Reader file.  This is in fact is great solution to the lack of manuals since it is a fully thumb nailed solution easy to navigate and to find the answers to all of yours doubts.

III. Returns

3.1   ALL SALES ARE FINAL in our site so please make sure that you understand what you are buying prior to checking out, particularly with regards to compatibility with your carrier. Remember, if you are a Cingular customer inside the U.S., we recommend that you only purchase QUADBAND mobiles that can be seen here. Celluloco.com will follow the strict rules and regulations set forth in our Return Policy which exists to remedy only rate events where a product shipped to you may arrive defective. If you happen to be one the lucky ones, please make sure to follow proper return procedures here and DO NOT SHIP us back anything without an RMA authorization code as your package will be refused. Please inquire about your RMA in our Return Policy. Prior to doing so, you may elect to see whether there is anything that you are failing to do with your mobile that is preventing you from achieving "registry" of service of your SIM card such as making sure that the mobile is in the right band selection so on and so forth....If your mobile arrived in a foreign language, please don't freak out! Look at this page for help (your mobile may well be here) or call us at (305)374-5131 for help ....we'll gladly assist to ensure that you're able to get the mobile to English. Please note that finding out that your mobile has no warranty in the U.S. is not a reason for a return since we are taking the time to legally disclose this fact to you prior to your purchase in several places in this site, including the product page of your gadget in the "includes" tab!

IV . Sales Tax & Duties

4.1   Your order will only subject to a 7% sales tax if we are shipping it to anywhere within the State of Florida. For all other 49 states and contiguous U.S. territories, no taxes will ever apply.

4.2   Your order will be subject to duties if we are delivering it to any other country than the U.S. While we cannot tell you what those will be for each individual country, we do however, take some crucial steps to assist you in circumventing the overpayment of these duties such as declaring your package as an "unsolicited gift" and making no mention of Celluloco.com anywhere outside of the box being shipped.

V. Pricing Policy

5.1   Due to the foreign exchange rate oscillations and sudden foreign market demand changes/shortages of all the products herein offered at this site, they may suffer price changes overnight without any prior warning.  Operating inside this volatile trading environment, it is customary for Celluloco.com to change prices on its products as often as twice in the very same day. When purchasing at this site, you agree to hold Celluloco.com harmless of any liabilities to you arising from such possible sudden price drops. We hope that you will comprehend that this is an embedded risk in the importing business that needs to be understood by all of our shoppers.

5.2   If a price is corrected due to exceptional circumstances, customers will be informed of the change before payment is processed and offered the opportunity to cancel the order.

5.3   If an order is placed for an item with an erroneous price, and the erroneous price is less than the cost price of the item, we reserve the right to either not  honor such order.

5.4  Prices on orders for out-of-stock or pre-release items are valid for the duration of time until the product arrives in our warehouse. If the price changes when stock becomes available or before its availability due to any unexpected announcement by the manufacturer, Celluloco.com will offer the shopper the opportunity of buying the item at the lesser price or cancel the order.  Pre-release orders will not be processed against your credit card until the product becomes physically available in or warehouse.  All pre-release order placers  will be notified via email of the arrival of their gadgets before everyone else that visits the site.

VI. Privacy


6.1   Celluloco.com employs the latest state of the art encryption service to collect your personal information through the acquisition of a 128bit encrypted digital certificate from Thawte Verisign.  Thawte Verisign provides us with a secured medium that has never yet been compromised in the history of cyber attacks with which to travel your sensitive information from your PC into our servers. 

6.2   Celluloco.com will collect your personal and credit card information throughout in your check out process in our shopping cart. These pieces of information are safe guarded in your file (encrypted in our 128bit SSL servers) and will not be shared with any third parties or for used for any other purpose other than the specified request you will place in your order. Our server data collection procedure follows lawful accordance with the Data Protection Act 1998.

6.3   Your e-mail address will not be shared with any third parties for future spamming. Celluloco.com may from time to time send you updates on releases and major sales on this email address. It is an exclusive connection between you and our servers without any margin of entry by anyone else. Entry to our secured server can be easily identified by the presence of a keypad icon on top right hand side of your screen. The keypad icon stays there until you complete your purchase and get an on screen confirmation that it went through successfully.

7.3   Unfortunately, from time to time we get a few clowns that enter fraudulently gathered credit card information on our site hoping to gain financially from this scam. A message to you, the perpetrator, is that we are keenly aware of your presence any time you enter our site and we can trace every one of your moves down to the last digit of your IP address (even if dynamic). We will block you from our site and the physical location of your IP address will be forwarded to the that local authorities for proper investigation. Conversely, we must disclose to the real card holder that his or her name will be permanently blocked of entry from our site in an effort to prevent perpetrator from using the card from yet another location.

7.4   If you have been a victim of fraudulent use of your information in our site or any type of unauthorized use of your credit card, we advise you that Celluloco.com cannot be held liable for any losses caused as a result of that unauthorized access of your information provided by to us.

VIII.  Business Customers - Wholesale Purchasing

8.3   If you are a business or if the goods are used wholly or in part for business purposes, Celluloco.com shall not be liable to you for any business loss including loss of profits, (whether direct or indirect) data, revenue, goodwill, or incidental, or consequential loss that you may suffer as a result of the purchase of goods from us. Any other liability shall be limited to the price paid for the goods. We do not exclude our liability for death or personal injury. You will not export any goods purchased from us in contravention of United States of America export controls.

IX. General

9.1   Celluloco.com reserves the right to decline any order for any reason.

9.2   All pictures on our website are the best indication we can give of the original item and are for illustration purposes only. From time to time the manufacturer may make small changes to the design of a product. Due to this, the item/items you receive may have small differences to the picture displayed on the website. The color of goods may vary slightly from that shown on the website due to limitations of browser software and monitors.  In addition, there will be times when we note that a mobile includes a headset in its description "INCLUDES" and we may ship that same mobile to you without one.  This is mainly due to the fact that we purchase mobiles form different countries and these package the mobiles differently. If this happens to you, please don't freak out and start calling your credit card company to dispute as some anal retentive "politically correct" shoppers of this site are quick to do.. Just email us your shortage here and we'll take care of it. Please don't make a mountain out of a molehill. We can't be blamed if your life at home/business isn't going as well as you expect it to...

9.3   Please note using accessories not produced by the original manufacturer of your mobile phone may affect the warranty of your mobile. We cannot be held responsible for any affects on your warranty from using these goods.

9.4   All products available from Celluloco.com are supplied with a 12 month manufacturer's warranty however certain products may have a shorter warranty time such as batteries, which carry 30 day manufacturer's warranty only. 

9.5 All terms and regulations of sale aforementioned are governed by the laws of the State of Florida, U.S. and any disputes will be decided only by its courts.
